I hereby grant to BlackBerry Limited (“BlackBerry”) and its agencies, subsidiaries and affiliates, the absolute and irrevocable right and unrestricted permission to record and use my name, image, voice and likeness in connection with any film, photograph, videotape, audio recording and/or other recording of my image and/or voice (collectively, “Recording”), and to edit, alter, copy, exhibit, distribute, use, reuse, publish, and republish the Recording, in whole or part, individually or in any and all media now or hereafter known, for any purpose, including but not limited to for illustration, promotion, art, editorial, advertising and commercial purposes. I waive the right to inspect and approve the finished product, including written or electronic copy, wherein my name, image, voice and/or likeness appears. Additionally, I waive any right to royalties or other compensation arising from or related to the use of the Recording. Further, I grant BlackBerry the right to license the finished product to third parties to use, distribute and publish for commercial and other purposes.

I hereby release and discharge BlackBerry and its officers, directors, employees, agents, subsidiaries, affiliates, assigns and authorized licensees, from any and all claims and demands arising out of or in connection with the use of the Recording, including without limitation, any and all claims for defamation or invasion of privacy.

I am the person whose name appears below, and I have the right to contract in my name. I have read the foregoing and fully understand its contents. This release shall be binding upon me and my legal representatives, heirs and assigns.

COURSE REGISTRATION TERMS & CONDITIONS 

The BlackBerry Malaysia Center of Excellence Sdn. Bhd (“BLACKBERRY”) provides cybersecurity training courses at the Cybersecurity Center of Excellence in Malaysia (“CCoE”), located at Jalan Impact, Cyber 6, 63000 Cyberjaya, Selangor, Malaysia. 

By registering for any training program or course (each a “Course”, collectively “Courses”) at the CCoE or by using or accessing any Course material, you (the “Registrant”, “you”) agree to be bound by these terms and conditions (“Terms & Conditions”). 


1. REGISTRATION

(A) By registering for a Course, you represent and warrant that you are 18 years of age or older and have reached the age of majority in your respective country of residence.

(B) To register for a Course, you must select the applicable Course from the CCoE’s list of Course offerings and submit the Course registration form, available on the CCoE website: www.blackberry.com/us/en/services/cybersecurity-center-excellence-malaysia.You may be required to provide additional information at the time of registration, including but not limited to your name, mailing address and email address. You may be required to pay a registration fee to register for select Courses. 

(C) Space is limited for each Course and are available for registration on a first-come-first-served basis.All courses are subject to confirmation by the CCoE. All Courses are offered for individual registration and access only. Course materials may not be used, distributed to or viewed by any person other than the Registrant. Registrants may not transfer or share Courses, including Course materials, with other individuals.

(D) You understand and agree that all information provided by you is accurate, current and complete and that you will maintain and update your information to keep it accurate, current and complete. If any of the information provided by you is untrue, inaccurate or incomplete, we reserve the right to refuse or cancel your registration for the Course. 


2. FEES

BLACKBERRY may offer Courses at the CCoE for free or require a registration fee at its sole discretion. Any applicable fees will be noted in the list of Course offerings during registration, and payment instructions will be provided to the Registrant via email upon registration. Payment of any applicable fees is required prior to your attendance of the registered Course. BLACKBERRY will not guarantee registration for a Course until all applicable fees have been paid.


3. ATTENDANCE

Regular attendance is required for all Courses. Full attendance is mandatory for course completion unless excused due to illness or other valid reasons approved by the CCoE. Registrants must attend all days of the Course to receive a Certificate of Completion. 


4. SUBSTITUTIONS, CANCELLATIONS AND MODIFICATIONS

(A) You may submit a request to substitute a registered Course for a different Course by emailing ccoemalaysia@blackberry.com no later than seven (7) business days prior to the scheduled start date of the registered Course. Substitution requests are granted at the sole discretion of BLACKBERRY.

(B) You may request to cancel your registration for a registered Course by emailing ccoemalaysia@blackberry.com no later than seven (7) business days prior to the scheduled start date of the registered Course (“Cancellation Deadline”). No refunds will be provided. If the cancellation request is received prior to the Cancellation Deadline, BLACKBERRY will provide a credit for any applicable registration fees, which can be used toward another Course. If you fail to attend the registered Course without giving notice to the CCoE prior to the Cancellation Deadline, you may be dropped from the Course and no refund or credit will be provided.

(C) BLACKBERRY reserves the right to cancel or postpone any Course due to low enrollment, weather conditions, instructor illness, or other unforeseeable circumstance. BLACKBERRY will notify Registrants as soon as practicable if a Course is cancelled or postponed. In the event of cancellation by BLACKBERRY, you may elect to receive a full refund of any applicable registration fees or credit toward another Course. Notwithstanding, in the event that a Course has to be cancelled or changed due to events beyond BLACKBERRY’s control, BLACKBERRY and its affiliates will not be held liable to Registrant for any damages, losses or costs incurred. 

(D) Every effort will be made to keep Course content and instructors as represented. However, unforeseen circumstances may result in changes to the Course content or instructors. BLACKBERRY reserves the right, in its sole discretion, to make changes to the Course program. BLACKBERRY is not liable for modifications to the Course program date, content, speakers or venue.

(E) BLACKBERRY reserves the right to blacklist or refuse enrollment to any individual that repeatedly registers for Course(s) and fails to attend the registered Course(s) without prior notice to the CCOE. 


5. CODE OF CONDUCT

BLACKBERRY does not tolerate behavior that is unprofessional, disrespectful, or inappropriate. BLACKBERRY expects all individuals to help promote a safe and respectful learning environment that is free from all forms of discrimination, harassment and inappropriate conduct. By registering for a Course, you acknowledge and agree that BLACKBERRY reserves the right to remove you from the Course without a refund or credit if BLACKBERRY, in its sole discretion, determines that your participation or behavior creates a disruption or hinders the Course program.


6. RELEASE FROM LIABILITY

(A) By registering for or attending a Course, you agree to release and hold harmless BLACKBERRY, its parent companies, subsidiaries, affiliates, agents and representatives and each of their officers, directors, agents, representatives and employees (each a "Released Party" and collectively, "Released Parties") from any and all claims, demands, liabilities, losses or damages whatsoever for any loss, injury, illness, death or damage incurred to your person or property arising from your participation in or in connection with the Course program.

(B) By registering for or attending a Course, you agree to assume all liability for any loss, injury, illness, death or damages incurred by you or any other person arising out of your participation in the Course program. You further agree to indemnify and hold harmless the Released Parties from any and all claims, demands, liabilities, losses or damages, whether direct or indirect, which may be made (including by you) against the Released Parties arising out of, or in consequence of, any loss, injury, death or damage incurred by you or any other person or property resulting from your act or omission, whether intentional or unintentional, at the CCoE.


7. CONSENT TO USE OF PERSONAL INFORMATION

(A) BLACKBERRY may collect personal information during the registration process such as name, mailing address and email address in order to administer registration, prepare Course materials and provide access to the CCoE.

(B) By registering for a Course, you agree to receive email communications about services, products, Course offerings and events from BLACKBERRY and its affiliates. You may opt-out or unsubscribe at any time by emailing BLACKBERRY at ccoemalaysia@blackberry.com. 

(C) BLACKBERRY respects the privacy and security of the information provided by you. By registering for a Course, you consent to the collection, use, and disclosure of the information by BLACKBERRY or its service providers on BLACKBERRY’s behalf: 

(i) to administer registration, participation and access to the CCoE; 

(ii) to contact you after the Course for evaluation purposes and for subsequent CCoE notifications and Course registrations; 

(iii) for BLACKBERRY's internal use, including without limitation, to: 

(a) understand and meet your needs and preferences, 

(b) develop new and enhance existing services, products and Course offerings, 

(c) manage and develop BLACKBERRY’s business and operations, and 

(d) to provide you with relevant information about BLACKBERRY and/or its products, services and Course offerings; and 

(iv) for the purposes set out in BLACKBERRY’s Privacy Policy which can be found at https://us.blackberry.com/legal/privacy-policy. Except as set out herein, BLACKBERRY will not disclose your personal information to third parties for marketing or other secondary purposes, although BLACKBERRY may disclose aggregated, non-identifying data relating to the CCoE for marketing or other purposes.


8. INTELLECTUAL PROPERTY

(A) All information and materials presented or distributed at or in connection with any Course are the intellectual property owned by BLACKBERRY or instructor(s) at the CCoE. You may not use or reproduce or allow anyone to use or reproduce any such materials for any reason without the prior written permission of BLACKBERRY or its respective owner.

(B) Photographs, audio recordings and video recordings of the Course program are strictly prohibited unless you have obtained express written consent from BLACKBERRY. By attending a Course, you agree not to record, broadcast and/or distribute any photographs, audio recordings and/or video recordings of the Course program without express written permission from BLACKBERRY.


9. GENERAL

(A) By attending any Course, you agree that 

(i) BLACKBERRY may take photographs, audio recordings and/or video recordings of you during the Course program, 

(ii) BLACKBERRY may use your name, photograph, image, likeness, recorded voice and statements (collectively, "Information") perpetually and globally in connection with the Course program and/or the CCoE, in whole or in part, in all media and/or distribution formats, now known and hereafter developed for any lawful purpose, including but not limited to marketing, advertising, publicity, educational, sales, trade, and promotional purposes, with no right ofapproval and no right to compensation. You release and discharge BLACKBERRY from and against any and all claims, damages, costs and/or other liability arising from or relating to use of the Information. BLACKBERRY shall be the exclusive owner of any and all rights, title and interest, including, without limitation, copyright, electronic and distribution rights, in and to any materials containing the Information created by or on behalf of BLACKBERRY, in any form. Further, you agree that BLACKBERRY has the right to license any photographs, audio recordings and/or video recordings of you to third parties to use, distribute and publish for commercial and other purposes.

(B) BLACKBERRY reserves the right to review and amend these Terms & Conditions from time-to-time at its sole discretion, and you will be deemed to have accepted any and all amendments if you participate in any Course or access any Course material after the date the amendments were made available. 

(C) This Agreement shall be governed by and construed under the laws of Malaysia. Each Party consentsto the exclusive jurisdiction of the courts of Malaysia and waives any objection on the grounds of venue, forum non-conveniens or any similar grounds and consents to service of process by mail or in any other manner permitted by applicable law.
