Two large regional Northeast U.S. law firms each said that they are hiring 10 lawyers from Boston-based rival Burns & Levinson, which said it was winding down following a series of departures earlier this year. McCarter & English, LLP said it has hired seven Burns & Levinson partners whose practices span trusts and estates work, real estate and business litigation. Nine professional staffers are also making the move to the Newark-founded firm. Ten other intellectual property and real estate lawyers are joining Barclay Damon LLP, a 300-lawyer firm with offices in New York, Boston, Toronto and Washington, D.C., firm chair John Langan told Reuters. Burns & Levinson struggled following a string of departures earlier this year, including a 25-lawyer group that left to open a Boston office for Blank Rome and a 17-lawyer group that joined ArentFox Schiff. More reflections on the #Danielslaw ruling last week: Plaintiffs (and the NJ AG) argued the law was subject to a negligence standard and the court agreed, fine. But watch now the next step: plaintiffs will argue that the act of not complying with a data subject request is per se negligent. Thus transforming what is supposed to be a negligence standard - necessary to save the statute on constitutional grounds - into a strict liability statute. We see this in #databreach cases where the fact of a breach is used to argue the existence of negligence and too many courts buy it.

🚨DWI Conviction Appeal: The importance of Procedural Compliance in The Judicial System🚨 On April 4, 2024, the NJ Appellate Division decided the consolidated cases of State of New Jersey v. Wongyu Jang and State of New Jersey v. Sasha Quashie, which reversed the convictions of both defendants due to critical procedural errors. This significant ruling underscores the importance of procedural compliance in the judicial system. Both Jang and Quashie were initially convicted of DWI and related offenses in municipal court. Their appeals to the Law Division were decided without the mandated hearings, violating court rules and due process rights. The Appellate Division criticized the lower court's failure to allow the defendants to argue their cases or present briefs, a fundamental right in the appeals process. The court's decision to reverse the convictions and remand for new trials, to be conducted by a different judge, highlights the necessity of adhering to procedural norms to ensure fairness and uphold the integrity of the legal process. The USPTO leadership issued a decision (a rejection), dated May 21, 2024, in an ARP, attached, in the Xencor case remanded from the Federal Circuit and now styled as In re Chamberlain. I focus only on MPF claim 9 in this post and not on Jepson claim 8. The PTO maintained the Board's written description rejection of claim 9 on the failure of "treating a patient" to possess written description support, found claim 9 to be a Section 112(6) claim (pre-AIA), ruled that written description and definiteness do not require the Specification to describe equivalents of 5G1.1 to meet the definiteness or written description requirements; did not maintain the Board's indefiniteness rejection of claim 9; ruled in Xencor's favor on non-statutory obviousness-type double patenting of claim 9 over claims 1-5 of the '818 patent and Schwaeble; and on obviousness-type double patenting of claim 9 over claim 1 of the '543 patent and Schwaeble. There is much to unpack here, but basically, as it appeared to me that Xencor won on every issue except written description for "treating a patient," it seems to me that the following revised MPF claim 9 just might be successful: 9      An anti-C5 antibody comprising: a) means for binding human C5 protein; and b) only one modified (see note 12 of ARP) Fc domain comprising amino acid substitutions M428L/N434S as compared to a human Fe polypeptide, wherein numbering is according to the EU index of Kabat, wherein said anti-C5 antibody with said amino acid substitutions has increased in vivo half-life as compared to said antibody without said substitutions. But, in view of note 16 of the opinion at p. 40; it might be advisable to drop the two wherein clauses and rewrite b) as means for increasing the in vivo half-life of the antibody and link that "b) means for" to "only one modified (see note)12 of ARP) Fc domain comprising amino acid substitutions M428L/N434S. 🚨 NJ Appellate Division Decision – Jurisdictional Law on Sex Abuse Litigation 🚨 On February 28, 2024, the NJ Appellate Division decided E.T., A.M., A.R., and others v. The Boys and Girls Clubs of America, reversing the lower court's decision that New Jersey courts have specific personal jurisdiction over the Boys and Girls Clubs of America (BGCA) in a case involving allegations of sexual abuse by a counselor within The Boys and Girls Clubs of Hudson County. This pivotal decision highlights the complexities of jurisdictional law, particularly in cases involving national organizations with local affiliates.   In this case, the plaintiffs alleged they were sexually abused by Arthur Freudenberg, a part-time counselor for the Hudson County BGC, between approximately 1978 and 1982. They sought compensatory and punitive damages from the local entity and the national organization, BGCA. However, jurisdictional discovery showed that BGCA, based in Georgia, did not have direct control over the local club's hiring, training, or supervision practices, including those of Freudenberg. The Appellate Division found that BGCA's connection to New Jersey, through affiliation and brand used by the Hudson County BGC, did not constitute purposeful availment of New Jersey jurisdiction concerning the allegations.   This decision significantly marks the limits of specific personal jurisdiction and underscores the need for clarity in the operational relationships between national organizations and their local affiliates.   Read the Full Decision Here: https://lnkd.in/ePagx6NE   Stay informed with regular legal updates from our team of former prosecutors at the Bianchi Law Group.
