The United States District Court for the Northern District of California has granted preliminary approval to a $490 million recovery in a securities fraud class action against Apple. The case concerns allegations that Apple’s CEO made false and misleading statements to investors. A bit of the backstory: In November 2018, Apple allegedly misrepresented the status of the company's current business in China, which included the impact of the slowing economy in China and the demand for iPhones in the region. Just two months later, in January 2019, Apple announced that it would miss its quarterly earnings due to weak iPhone sales and economic problems in China. This news caused Apple stock to plummet more than 9%, which resulted in significant losses for investors. If finally approved, the case will be the third-largest securities class action recovery ever in the Northern District of California and the fifth-largest such recovery ever in the Ninth Circuit. Congrats to our partners James Barz, Robert Robbins, and Sabrina Tirabassi. On May 22nd, the U.S. District Court for the Northern District of Illinois granted final approval of $29.25 million recovery in a securities class action case against GoHealth. The case alleges that GoHealth concealed a change in business strategy that included rapid customer expansion and also concealed the associated negative financial impact of the change on the company's key financial metrics at the time of and after its IPO. Our suit on behalf of investors alleged that, by failing to disclose this shift and its negative financial impacts, GoHealth’s IPO Registration Statement claims, such as, that it would rapidly expand its business while also improving its financial performance were false and misleading. It used to be that, when you wanted to include a document in an email, you'd attach it. But most people these days just drop a link. When it comes to discovery in litigation, courts have regularly required attachments be produced along with and directly following the parent document. But courts have not consistently taken this approach for documents hyperlinked inside an email. So, when is the linked document required to be produced and is the identification of the relationship between the communication and the linked document also required? Partners Lea Malani Bays and Stuart Davidson recently co-authored an article in the University of Cincinnati Law Review entitled "The Missing Links," in which they make the case for advancing the law of e-discovery to keep up with changes in technology and user behavior in using links rather than attachments. All discovery gurus and enthusiasts will enjoy their comprehensive, thoughtful analysis of the various cases exploring this issue. Green Dot has allegedly failed to disclose that their high-fee prepaid debit card business was not performing as well as they claimed to investors.
