We proudly announce that Robbins Geller successfully defeated a motion to dismiss against HP Inc. (“HP”) and its executives. This victory follows our Firm’s 2023 appellate win in the case. Previously, the district court dismissed the case and Robbins Geller appealed. The Ninth Circuit Court of Appeals agreed and reversed the district court’s order dismissing the case. Notably, in reversing the dismissal, the Ninth Circuit also clarified how statutes of limitations apply in federal securities class actions. “We’re pleased with the court’s ruling and look forward to advancing the class’s claims in discovery,” said our partner Darryl Alvarado, who represents the lead plaintiff on the case. “When companies go public to take advantage of the capital offered by the securities markets, it’s important for investors to enforce the securities laws and encourage full disclosure. We’re very pleased with this result and proud of our clients,” said our partner Robert Robbins. Robert and our partner Jim Barz recently resolved a shareholder suit against GoHealth regarding allegations of misstatements made in connection with the company's IPO. GoHealth has agreed to pay investors $29.25 million to resolve shareholders' claims that the company failed to disclose a strategic business shift that it implemented shortly before its IPO. According to allegations in our complaint, GoHealth's business shift included rapid customer expansion and associated negative impacts on the company's key financial metrics at the time of and after its IPO. Our suit on behalf of investors alleged that, by failing to disclose this shift and its financial impacts, GoHealth’s IPO Registration Statement claims that it would rapidly expand its business while improving its financial performance were false and misleading. The recovery is pending final approval before Judge Jeremy C. Daniel of the U. S. District Court for the Northern District of Illinois. Read more about the case here: https://lnkd.in/gVrPwdGy
